Kona, that is good news! If the EFF can't help you, I'm pretty sure Randazzo could file a dismissal on your behalf, pretty cheaply. They can just copy much of the last request for dismissal, and they were VERY nice when I spoke to them on the phone a few months ago.

The VegasInc reporter has been very good about covering the whole story. He was on a local Face-to-Face tv show last Friday about this ruling. Pretty much said what he wrote in the above article. An invitation by the tv host to the Righthaven representative was accepted for Monday. We taped the show but there was nothing about Righthaven. I think the attorney realized they are in deep do-do now.

Kitt - I'm the terrible person who posted an article from the Las Vegas Review Journal (regarding Survivor's Rupert inventing a card game and trying to get a local casino to test it). I clearly posted the link back to the RJ at the top of the article, and the author's name & contact phone number at the bottom. In the lawsuit the original "owner" of TVClubhouse (who hasn't been moderating or administrating the boards for years) and myself were named. The entire suit is a troll as Righthaven was "assigned" the copyright in APRIL but don't really OWN the work (that still belongs to the reporter and the newspaper according to recent legal rulings against Righthaven). Hubby & I did some additional googling and found the exact same article posted in another reality TV forum and they weren't sued. Righthaven has contracted with LVRJ and with the Denver Post to "uphold the rights of online newspapers & protect them against copyright infringing freeloaders on the internet". They make their money by finding these cut/pastes articles & photos on the internet, then have the newspaper/media company assign the copyright so they can sue. They don't ask for cease & desist (or to take down the content). Instead, they demand $150,000 (and they used to include that computers, domain name, etc from the websites be turned over to them but that got nixed after the first defendent fought back). Their revenue model works on scare tactics and settlements (they'll take $3-4K instead of you having to get a lawyer and go to court, etc). Rumor is they have filed >225 suits and generated about $400K so far in two years. But now folks are fighting back and the courts have gotten wind of this - judges are NOT happy with Righthaven and so far everything has been in favor of the defendents. They sound like the new version of ambulance chasers. I saw something today with a similar sort of suit, and the judge dismissed it as he said there was no proof that copying the text of the article stopped anyone actually going to the original source. LOL, found the article and it was actually about Righthaven! I'm very glad they're getting quashed in so many ways.

I had the opportunity to speak with David Kerr (the attorney in the above linked article) when all this came to TVCH. He spent more than 30 minutes on the phone with me, at no charge, offering advice and real concern. He's really a stellar gentleman, as well as a great attorney.

Attention On Board Get it, on Board? On the TVCH Board) A couple of announcements for everyone. We are going to be making a couple of changes to the website and message board in the next couple of days. Both of these changes are to help the board server performance during this much busier time of year. Those changes are: 1) Big Brother area will be viewable without membership. Posting will, of course, still require an active account. Member only areas take a little more processing to serve than an area the general public may read, so this should help keep the board running smoothly. 2) "Recent Active Discussions" from the front page will be disabled until after the Big Brother season is over. The front page feature for "Recent Active Discussions" has been misused in the past to track when messages in certain threads of Big Brother were posted in rather than the existing 'Search' tool or simply looking into the thread to see. Because of the way this feature works, it takes a considerable amount of server resources every time it runs. By turning this feature off, we should see a little better performance on the board overall. Of course, it isn't really an issue during the 'off' season, but now it is. We apologize for any inconvenience this may cause any of you but please know we are really trying to look out for what is best overall for the board. And while we have your attention. From the above article: U.S. District Judge Philip Pro awarded the fees Monday in the case of Kentucky message board poster Wayne Hoehn. Pro on June 20 dismissed Righthaven’s lawsuit against Hoehn, finding Righthaven didn’t have standing to sue him and even if it did, Hoehn was protected by the fair use doctrine in posting an entire Las Vegas Review-Journal column on a sports betting website message board. Righthaven's lack of standing was due to the R-J maintaining control of the column despite Righthaven's claims of ownership. That is most excellent news!!

Twiggy, they bank on people settling for a couple of thousand out of court, since in general that's less expensive than fighting. Before people started fighting back, they'd made about a half mil on these kinds of settlements.
