I totally agree Mummy. I would not want my actions that I do in the privacy of my home or hotel vacation to be held against me in my job. I'm pretty sure that what happens in Vegas will probably stay in Vegas but these idiots haven't realized that what they say is being analyzed and played over and over on YouTube.

If I behave in a way that speaks to my character, of course I would be fired. A woman I used to work with was stopped for a DUI. When she came back to work she bragged about it laughingly. She was terminated a week later. She tried to sue, but couldn't find a lawyer to take her case since we live in an at will state.

I agree buba... they have no expectation of privacy...

Plus, they listed where they work on their applications. To some point, they are seen as a representative of company.

If I was publically known as a racist/homophobic/loud mouth/irrational/idiot acting jerk... my job would fire me in a heartbeat.

Being those things is not protected under Title 7... without a union contact, or other employment contract, all jobs are AT will... and your employer has the right to fire you for doing things in public they do not agree to.

Getting drunk and showing up on the nightly news or COPS are all reasons your employer can can you...

especially when you consider their jobs. One, a model who would represent sponsors of different products, good luck finding any sponsor who would want you promoting her product:

If I smoke pot on my time, vacation or off days, I can be fired if drug tested. And pot can stay in your system up to a month or longer.
I also agree that the HGs represent their employer and as such may be terminated if their views reflect poorly on the company.

I agree that what you do away from work can definitely impact your job. One of my old jobs, our helicopter pilot crashed his car on his day off, forgot if he was drunk, or drag racing, or both. Even though he was a great pilot and never had any issues at work, they fired him.

Spencer should never have said he worked for Union Pacific. When he did that he kind of forced them to do something about the things coming out of his big mouth, because they became associated with the company. Whatever discipline he gets is his own fault.

I've not really been watching this season but I just found out yesterday not only is Spencer from the town of Conway ....which is where I live...but one of my bosses is somehow related to him.


Not sure if that's good or bad but my boss doesn't really claim anything to do with that part of the family.

Then having police search his home recently to see if there is child porn.. probably not what the union wanted to hear.

And those things on top of the statements he's made.

Gina Marie represented a pageant and while that world isn't really all that "clean", they don't want the racist statements from their representative who is training young girls/women.

Aaryn.. guess the agent just didn't want to have her represent them. Plenty of models to choose from.

I let someone go because he told me he just put up his house for sale because the N words just moved onto his block. It was a statement that stunned me. 2 weeks later I let him go. I don't need to spend my payroll dollars on employees that talk/think like that. I have clients that are black and didn't want to risk him using language like he did.

Aaryn has stated several times she wants to be a correspondent of some kind on tv....it is unlikely that anyone would hire her probably because similar to my decision to let my employee go....you can't afford for her to spout her racist tendencies in front of your viewers/clients/customer.

I think that is a great example of a very valid reason for firing someone. It is also a great example of how free speech is allowed in America (he can say that if he wants to say it) but that there are consequences to what he says (it makes him no longer likeable or employable for your business).

I'm not sure why people have so much trouble understanding free speech rights and somehow think it gives them the right to say anything they want with zero consequences.

In my state, you can get hit with a lawsuit for that kind of firing, and unemployment. You can only fire for violating work place written policies, and you have to give several warnings first and opportunities for the employee to fix the problem.

People can sue for anything...proving it is not always a slam dunk.

Federal law trumps state law...and there are only certain things that are protected by Title 7.

Employers can legally fire you for any reason...unless the reason comes under the protection of Title 7.

I would love to meet the attorney who files suit with expectation of winning, in a case where someone was fired for referring to another person as the N word...

Jimmer, yes, you do. You need a written code of conduct that specifies what is not acceptable behavior and what things (like stealing, etc) can constitute grounds for immediate firing.

If you don't, then you must first *warn* an employee of unacceptable behavior, and then give them an opportunity to correct it.

Otherwise, you can be sued for "wrongful termination." At the very least, you will be forced to pay unemployment benefits.

I've been through this, and while we won the wrongful termination suit (we actually had her sign an agreement that she would not sue in return for severance); but we lost the unemployment case.

This particular employee had a long list of terrible behavior, but because none of her warnings were in writing, we were screwed.

That's simply not true in all states. While wrongful termination cases are difficult to win, they are more common than you think. Discrimination is one of the reasons people win them.

Wasn't there just a case in the news about a woman being fired for being too attractive?

I live in an at will state, and have had to take numerous classes on employment practices. You can fire someone anytime and you don't have to give a reason. Of course,if that someone didn't violate company policy, and if they didn't have knowledge that what they did was reason for dismissal, they can draw unemployment.

Funny thing, we have one employee that I worked for when I was 18 and now days, I could have sued for sexual harassment...back then it wasn't heard of yet. That was over 30 years ago. Now, I'm HIS boss. I let them hire him because he is good at what he does...but only with the agreement that if he makes one step out of line, he is MINE! These comments these folks are making could follow them around for a looooong time. Sometimes, people don't forget.
